This Agreement establishes the conditions and procedure for providing paid services and is a public offer of TIDERIAN.ADVENTURES, LLC (Kyiv, Ukraine), hereinafter referred to as Organizer, represented by Director Iryna V. Voronova, acting on the basis of the Statute, for an indefinite number of persons within the meaning of p.p. 633, 641, 644 of the Civil Code of Ukraine, enter into an Agreement for the provision of services of organization of visiting Exclusion Zone and Zone of Unconditional (Mandatory) Resettlement (hereinafter - "Agreement") on the following terms.


Exclusion Zone and Zone of Unconditional (Mandatory) Resettlement (hereinafter — ChEZ) is a part of the territory of Ukraine that suffered the greatest from radioactive contamination as a result of the accident at the Chernobyl Nuclear Power Plant in 1986. In the territory of ChEZ special administration regime is applied according to the Ukrainian legislation currently in force.

Visitor – a full-fledged person, a citizen of Ukraine or a foreign state, who visits the ChEZ for informational purposes.

Visit – coming to ChEZ territory and being in it for information purposes with keeping to the Rules.

Rules – order of actions and behavior in the ChEZ territory, stated in the Order of Ministry of Emergencies of Ukraine N 1157 from 02.11.2011, registrated by Ministry of Justice of Ukraine on 18.11.2011. under
N 1319/20057.

Program of the Visit to the Exclusion Zone and Zone of Unconditional (Mandatory) Resettlement (hereinafter – Program) – a document containing the purpose of the Visit, the route, the amount and content of information which Visitors will be acquainted with or will be provided with; the data of the accompanying person and transport to be used for transfering the visitors through the ChEZ territory; date of Visit and list of Visitors.

The amount and content of information included to the Program of the Visit can be changed depending on the length of daylight hours, weather conditions, and also if specially directed by the administration of the Chernobyl Exclusion Zone.

1. Subject of the Agreement

1.1. Under this Agreement, the Organizer undertakes to provide the Visitor with a range of services for the organization of an informational visit to the Chornobyl Exclusion Zone and the Zone of unconditional (mandatory) resettlement (hereinafter ChEZ).

2. Rights and Responsibilities of the Parties

2.1. Organizer shall:

2.1.1. Perform the complex of organization and technical works aimed at preparation and carrying out of the Visit, namely:

-automobile transfer by the route: Kyiv – ChEZ – Kyiv


-excursion guidance according to the Program

- providing individual radiation accumulators for the period of the Visit for additional control of the radiation safety of the Visit.

2.1.2. Provide the Visitors with all necessary information about the order of the Visit and the Rules.

2.1.3. Familiarize the Visitor with the Rules under a personal signature.

2.1.4. Follow the Program and Rules during the Visit.

2.2. Visitor shall:

2.2.1. Timely provide the Organizer with accurate, complete and reliable information necessary for the Organizer to apply for a Visit through an automatic registration system, namely:

• full name and surname

• passport number

• citizenship

• date of birth

• mobile phone number

• e-mail address.

2.2.2. Get familiarized with the Rules and confirm it with a personal signature.

2.2.3. Follow the requirements of the Rules of Visit and follow the instructions of the accompanying guide all the time during the stay in the ChEZ territory.

2.2.4. Follow the rules of personal safety and public order all the time during the Visit.

2.2.5. Fulfill the payment for Organizer's service in proper time.

2.2.6. Carry a passport and a printed ticket ready to be submitted at the request of the police and/or the ChEZ administration all the time during Visit.

3. Agreement Value and Order of Payment

3.1. The cost of the Agreement is determined by the cost of services provided by the Organizer to the Visitor according to the prices published on the Organizer's website.

3.2. Services according to this Agreement are provided only upon condition of 100% advance payment.

4. Liabilities of the Parties and Force Majeure

4.1. In the case of non-execution of works according to this Agreement Parties bear responsibility under the laws of Ukraine currently in force.

4.2. The Visitor is personally responsible for any actions or omissions during the Visit that directly or indirectly caused harm or damage to any third parties, or for any actions or omissions that are a violation of current law of Ukraine.

4.3.In case of non-payment by Visitor of the Organizer's services cost, the Organizer has the right not to provide the Visitor with the services according to this Agreement.

4.4. In case of non-appearance or delay of the Visitor to board the transfer vehicle for any reasons, the funds paid for the services of the Organizer are not refundable.

4.5. The Organizer shall not be liable for violation of the terms of this Agreement, if such violation was caused by force majeure circumstances, including: actions and resolutions of state/local authorities; fire, flood, earthquake, other natural phenomena and/or exceptional weather conditions; disruption of power supply and/or communication lines, computer network failures and/or other technical circumstances beyond the control of the Organizer; strike actions, civil riots, unlawful acts of third parties, any other circumstances, not limited to the above, which objectively make it impossible for the Organizer to fulfill the obligations of the terms of this Agreement.

5. Other conditions

5.1. The Agreement enters into force from the moment of its conclusion (acceptance of the offer) and is valid until full fulfillment of all obligations by the Parties.

5.2. All disputes and disagreements that may arise between the Parties in connection with the conclusion, implementation and termination of this Agreement, which cannot be resolved through negotiations, shall be considered by the relevant court at the location of the Organizer in accordance with the claims procedure. The claim in writing must be sent to the postal address of the Organizer. The deadline for responding to the claim is 30 working days from the date of receipt of the claim by the Organizer.

5.4.The arbitral award is final and binding upon both Parties

5.5. This Agreement is made up in two copies both in Ukrainian and English, each having the equal legal effect.

5.6. The visitor agrees to the processing of his/her personal data, including: entering personal data into the database (without additional notice), lifelong storage of data, their accumulation, updating, changes (if necessary). The Organizer undertakes to protect the personal data of Visitors from unauthorized access by third parties, not to disseminate or transfer personal data to any third party (except for the transfer of personal data to commercial partners of the Organizer to perform work directly related to this Agreement and on mandatory request of the competent state authorities).

5.7. By applying to the Organizer for the services of organization of visiting Exclusion Zone and Zone of Unconditional (Mandatory) Resettlement, the Visitor claims their full and thorough understanding of the terms of this Agreement, confirms receivability of the terms of this Agreement and agrees with the terms of this Agreement.
